1. Scope

These Terms of Use govern the use of the I tesori della Russia website. By accessing the website, you accept these terms. Any deviating arrangement requires the written consent of GFM-Stiftung.

2. Nature of the website

The website is a digital collection, documentation and public-access platform. It is not a sales platform, binding offer, art-law advice, tax advice, provenance guarantee, authenticity confirmation or valuation report.

3. Collection and catalogue data

Artwork data, artist names, titles, dates, dimensions, techniques, attributions, provenance information, exhibition data, literature references, translations and editorial descriptions are maintained with great care. They may, however, be provisional, research-dependent, historically variable or subject to correction. Changes may be made at any time.

4. Permitted use

You may view the website in the ordinary manner and quote individual contents for private, scholarly, journalistic or educational purposes, provided that the source, artwork reference and copyright or rights notices are appropriately indicated and no image rights are infringed. Statutory copyright exceptions remain unaffected.

5. Prohibited use

Without the prior written consent of GFM-Stiftung, the following are prohibited in particular:

  • systematic extraction, scraping, harvesting, crawling or mirroring of artwork data, artist data, images or texts;
  • use of content for AI training, machine learning, image generation, data enrichment, commercial databases or similar purposes;
  • reproduction, publication, editing, distribution or commercial use of artwork images;
  • removal of rights notices, watermarks, source references or metadata;
  • any use that impairs the security, availability, integrity or reputation of the website, the collection, GFM-Stiftung or third parties.

6. Image rights and third-party rights

The display of an artwork on the website does not mean that all rights are cleared for further use. Artwork images, photographs and texts may be subject to different rights. For reproduction, publication or licensing enquiries, please contact info@gfmtrust.net.

7. External services and links

The website may contain external content and links. External services are subject to their own terms. To the extent permitted by law, GFM-Stiftung assumes no responsibility for the availability, content, privacy practices or security of external providers.

8. User submissions and communications

If you submit comments, information, documents or other content to us, you confirm that you are entitled to do so. You grant GFM-Stiftung the right to use such information for review, documentation, catalogue maintenance, provenance research and communication to the extent required for the relevant purpose. Confidential information should be submitted only after prior coordination.

9. Disclaimer of warranty

The website is provided “as available”. GFM-Stiftung endeavours to maintain it carefully but gives no warranty as to permanent availability, absence of errors, completeness, timeliness or fitness for a particular purpose.

10. Limitation of liability

To the extent permitted by law, GFM-Stiftung excludes liability for damages arising out of or in connection with the use of the website. Liability for wilful misconduct, gross negligence and mandatory statutory liability remains reserved.

11. Changes to the website and terms

GFM-Stiftung may amend content, functions, structure, accessibility and these Terms of Use at any time. The version published on the website is authoritative.

12. Governing law and jurisdiction

To the extent legally permissible, Swiss law applies, excluding conflict-of-law rules. The place of jurisdiction is Zurich, Switzerland, unless mandatory legal provisions provide otherwise.
